Xtreamfire US (referred to hereafter as "Xtreamfire") sets forth here its use policies, that must be observed by each and every of the clients and visitors ("Subscribers"), whenever using the services, the network and/or the systems or programs ("Services"), all property of Xtreamfire.
READ CAREFULLY THESE USE POLICIES BEFORE USING THIS SERVICE: By using Xtreamfire's website, you accept these use policies. If you don't accept these terms, then don't use Xtreamfire's website. Xtreamfire reserves the right, at its sole discretion, to change, modify, add to or remove parts of these terms at any time. The Subscriber should periodically review to see if these terms have changed. The continued use of Xtreamfire's website after the incorporation of changes to the present terms implies the acceptance of those terms.
The Subscribers (or their affiliates or clients) should respect these use policies avoiding engaging in doing or participating in the following prohibited activities:
All the services provided by Xtreamfire must be used for completely legal purposes. The transmission, storage, or presentation of any information, data or other materials in violation of any applicable law or regulation local, state, federal or international is prohibited. This includes, but is not limited to: materials with rights of authorship, obscene or aggressive materials, or material protected by trademark or other such intellectual property laws. Examples of content or links which are inacceptable are:
(i) Pornographic or sexually explicit Material that is outside the local, state, federal or other applicable laws concerning such Material.
(ii) Illegal Software ("pirated")
(iii) "Hacker" Programs or files.
- Violations of Intellectual Property Rights.
Any violation of materials protected by copyright, or any brand or trademark that is registered or patented, without the express permission of the copy, the owner of the registered trademark or of the patent rights is prohibited. Xtreamfire may be required by law to erase or block access to content under suspicion of violation of copyright or other applicable laws
Xtreamfire has committed to and has adopted a zero tolerance policy concerning SPAM. The term "SPAM" includes, but is not limited to, massive sending of unsolicited eMails and/or commercial messages on the Internet, also including "chain letters". Xtreamfire will determine under its sole discretion any violations of this policy on the part of Subscribers. The sale and/or the distribution through Xtreamfire's services of programs that generate SPAM is absolutely prohibited.
To register comments or complaints regarding SPAN being involved with any of Xtreamfire's services or its network, please send them promptly to abuse@xtreamfire.com.
- Viruses or other destructive activities
The use of the Services to create and/or send viruses, "worms" and/or "Trojan Horses" on the Internet, and likewise eMail bombs or denial of service (DOS) attacks are prohibited. All Subscribers must abstain from involving themselves in activities which may interrupt or interfere with the ability of the other Subscribers to use the other Services or to conduct their activities on the Internet, or that can result in same.
"Hacking" and related or similar activities are prohibited. "Hacking" includes, but is not limited to the following activities": accessing illegal or unauthorized computers, networks, restricted accounts or website or the penetration or intent to penetrate security measures and private zones.
It is absolutely forbidden to use the services for the storage, sending, deployment, transmission, advertising or publishing of child pornography in any way.
The presence and/or the transmission of child pornography will be reported immediately by Xtreamfire to the proper authorities.
The use of the services to carry out any illegal activities is prohibited. Illegal activates include, but are not limited to:
(i) Storing, sending, deploying, transmitting, advertising, announcing or publishing confidential information regarding credit cards without the permission of the owners
(ii) Introducing, publishing, sending eMails or any other manner of transmitting content to which you have no transmission rights under any law or under any contractual or financial relationship (such as privileged information, proprietary or confidential information or information revealed in a work relationship or under any other such agreements)
(iii) Not complying with applicable online privacy laws, including "stalking" or other manner of harassing the general public.
(iv) Introducing, publishing, sending eMail or in any other manner transmitting any content that infringes on any patent, registered trademark, commercial or other trade secrets, copyrights or any other property rights of any other party,
(v) Violating, with or without intention, any applicable local, state, federal or international law, including, but not limited to, regulations promulgated by the Federal Securities and Exchange Commission and/or other over site committees of the stock market, whatever regulation of whatever nation or other commission.
Infringements to this paragraph will be reported by Xtreamfire to the appropriate authorities and Xtreamfire will always cooperate in whatever manner is necessary with said authorities.
- Obscene, defamatory, abusive or threatening language
The use of the services is prohibited for introducing, publishing, sending by eMail or any other manner of transmitting whatsoever content that is counter to or goes against any law concerning harm, threat, abuse, assault, torture, defamation or that may be vulgar, obscene, slanderous, invade the privacy of another, generates racial or ethnic hatred or any other action of an objectionable motive.
Activities, that in the sole judgment of Xtreamfire, may interfere with or interrupt the Service or the servers or the internal networks connected to the Service, affect the affairs, reputation, good will, clients or commercial relations of Xtreamfire, or in any other way acts in a way that adversely affects the ability of other Subscribers to use the Services of Xtreamfire, is prohibited. Prohibited activities include making or taking disposition of any program, product or service intentionally designed or may be used for violating these use policies. In addition, subscribers who refuse to cooperate with Xtreamfire to correct or prevent violations of these policies will have their access to the services denied on behalf of Xtreamfire's clients.
Xtreamfire does not try to monitor systematically the content of Subscribers to ensure the observation of these policies, whenever Xtreamfire discovers possible violations of its Use Policies or the Use Agreement, Xtreamfire reserves the right to take such actions as needed to stop or correct such violations, said actions may include, but are not limited to, denying access to a Website, denying access to the Services and/or erasing information.
In addition, Xtreamfire reserves the right to take actions against the subscriber or against a client of said subscriber, including if said actions affect other clients of the same subscriber.

With a maximum response time of 24 hours (SLA) in order to give pursuit to its requests of technical support, excluding and without limiting a:
We strive to maintain a maximum response time of 24 hours (SLA) for us to attend to requests for technical support, excluding without limits the following: Internet connection problems, problems with your Internet Service Provider (ISP), virus infections or worms in the client's computer, configuration problems of programs for reading electronic mail, configuration of firewalls for accessing external ports, configuration of eMail accounts in instant-messaging systems, integration of eMail with third-party services, and any error originated by causes external to the provided service. The subscriber may receive assistance as a courtesy by our support staff even though Xtreamfire is under no obligation to provide such support and said representative is under no obligation to do so on the part of Xtreamfire.
Xtreamfire is committed to offer to its subscribers the means by which they can make periodic backups which need to be performed by the subscriber for their website's suitable operation. The subscribers will be able to receive courtesy assistance by our support personal on the backup procedure without this any obligation on the part of Xtreamfire to do so.
Xtreamfire has the right to reveal the content or whatever information that is in its power to do so, including the Subscriber's data, transmissions on the Internet and activities on the Internet, if required to do so by law or as required or believed in good faith to be required or that said revelation is reasonably necessary in order to:
(i) Comply with legal processes;
(ii) To fulfill the Use Agreement;
(iii) To respond to claims that involve any content that reduces the rights of third parties;
(iv) protect the rights, the property, or the security of Xtreamfire, its subscribers, clients and the general public.
Xtreamfire has no obligation to notify any party, including the Subscriber proper, regarding the revelation of said information.
- Distortion of Transmitted Information
It is prohibited to falsify, omit, suppress or to mask message headers, eMail addresses and/or IP addresses in order to hide, conceal or to distort the origin of a message.
ANY DISPUTE ARRISING FROM MATTERS CONCERNING THESE USE POLICIES FOR THE SERVICE DESCRIBED HEREIN WILL BE SUBJECT TO MEDIATION OR ARBITRATION SOLELY WITHIN THE LEGAL JURISDICTION OF DALLAS COUNTY, TEXAS AND ACCORDING TO THE LAWS OF THE STATE OF TEXAS. |
